These Terms of Service (the “Terms”) form an agreement between you and FellowPath (“FellowPath”, “we”, “us”, or “our”) regarding your use of our website, applications, and related services (together, the “Service”). By creating an account or using the Service, you agree to these Terms.
1. Acceptance of these Terms
By accessing or using the Service, you confirm that you have read, understood, and agreed to be bound by these Terms and by our Privacy Policy. If you do not agree, you must not use the Service.
2. Eligibility
The Service is intended for adults aged 18 or over who are medical practitioners, registrars, or students preparing for postgraduate medical examinations. By using the Service you confirm that you meet these requirements and that the information you provide is accurate.
3. Accounts
You are responsible for keeping your account credentials confidential and for everything that happens under your account. Accounts are personal to you and may not be shared, sold, transferred, or used by more than one person. Notify us promptly if you suspect unauthorised use of your account.
4. Access passes and payments
FellowPath is sold as a fixed-period access pass. When you purchase a pass, you receive access to the paid features of the Service for the period stated at checkout. Access passes are not auto-renewing subscriptions and will not be charged again automatically when they expire.
If you purchase a new pass while an existing pass is still active, the new period is added on from your existing expiry date. Prices, durations, and inclusions are displayed at checkout and may change from time to time, but changes will not affect a pass you have already purchased.
Payments are processed by a third-party payment processor. By paying, you agree to that processor’s terms in addition to these Terms. We do not store your full card number.
5. Refunds
Because the Service is delivered digitally and access begins immediately upon purchase, access passes are generally non-refundable once activated. We will, of course, honour any rights you have under the Australian Consumer Law, including where the Service is not delivered as described, is not of acceptable quality, or is not fit for its intended purpose. If you believe you are entitled to a refund, contact us at the email address below and we will work with you in good faith.
6. Acceptable use
You agree not to:
- copy, redistribute, publish, or sell any part of the question content or explanations;
- scrape, harvest, or otherwise extract content from the Service by automated means;
- reverse engineer, decompile, or attempt to derive the source code of the Service;
- share, sell, or transfer your account or any access pass to another person;
- use the Service to harass, harm, or impersonate any person or entity;
- circumvent or attempt to circumvent any access, security, or rate-limiting measure;
- use the Service in any way that breaches applicable law or these Terms.
We may suspend or terminate accounts that breach these rules without notice and without refund.
7. Intellectual property
FellowPath and its licensors own all rights, title, and interest in the Service, including the question bank, explanations, analytics, code, design, trade marks, and brand. Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Service for your own exam preparation during the period of your access pass. No other rights are granted to you.
8. Educational disclaimer
FellowPath is an exam-preparation tool, not clinical advice. The content is provided for educational purposes only and must not be used as a substitute for professional medical judgment, consultation, diagnosis, or treatment. You remain solely responsible for your clinical decisions, your patients’ care, and your performance in any examination.
FellowPath is an independent product. We are not affiliated with, endorsed by, or sponsored by the Royal Australian College of General Practitioners or any other examining body. References to the AKT, KFP, or other examinations are descriptive only.
We make reasonable efforts to keep the content accurate and current, but medicine evolves quickly and we do not warrant that every question or explanation reflects the latest guidelines. You should always check primary sources for clinical decisions.
9. User content and feedback
When you submit feedback, flags, comments, or other content through the Service, you grant FellowPath a worldwide, non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, and incorporate that content into the Service. You confirm that you have the rights to submit it and that it does not breach any third-party rights or applicable law. Do not submit content containing personal health information about identifiable patients.
10. Service availability
The Service is provided on an “as is” and “as available” basis. We work hard to keep it running smoothly, but we do not guarantee uninterrupted availability and may need to suspend, change, or discontinue features for maintenance, security, or operational reasons.
11. Limitation of liability
To the maximum extent permitted by law, FellowPath, its directors, employees, and suppliers will not be liable for any indirect, incidental, consequential, special, or exemplary damages, including loss of profits, data, goodwill, or opportunity, arising out of or in connection with your use of the Service.
Where any consumer guarantee under the Australian Consumer Law applies and cannot be excluded, our liability is limited (to the extent permitted by law) to resupplying the Service or refunding the price paid for the relevant access pass.
Nothing in these Terms is intended to exclude, restrict, or modify any right or remedy you may have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.
12. Indemnity
You agree to indemnify and hold FellowPath harmless from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right.
13. Termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if we are required to do so by law, or if continuing to provide the Service to you would expose us or other users to risk. On termination, your right to use the Service ends immediately. Sections that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, indemnity, and governing law, will continue to apply.
14. Governing law and jurisdiction
These Terms are governed by the laws of the State of Victoria, Australia, and the Commonwealth of Australia where applicable. You and FellowPath each submit to the non-exclusive jurisdiction of the courts of Victoria for any dispute arising out of or in connection with the Service or these Terms.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the Service or by email before they take effect. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms. If you do not agree, you must stop using the Service.
